Biz Card Maverick – Terms of Use

Please read these Terms of Use (“Terms”) carefully before using Biz Card Maverick. By creating an account or using the Biz Card Maverick mobile application and related services (collectively, the “Service”), you agree to be bound by these Terms. This is a legal agreement between you and Client Focused Media (the operator of Biz Card Maverick) – referred to as “Biz Card Maverick,” “we,” “us,” or “our.” If you do not agree with these Terms, you must not use the Service.

1. Scope of Use

Business Use Only: Biz Card Maverick is intended solely for business and professional use. You may use the Service to scan and manage business contact information obtained through professional interactions (e.g. exchanging business cards at networking events or meetings). Personal, household, or consumer use of the Service is not permitted. By using Biz Card Maverick, you represent that you are using it for business purposes.

Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you are using Biz Card Maverick on behalf of a company or other organization, you represent that you have the authority to bind that entity to these Terms, and in that case “you” and “your” will refer to that entity.

2. Account Registration and Security

To access most features, you will need to create a Biz Card Maverick account. You agree to provide accurate, current, and complete information during registration and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at our support email if you suspect any unauthorized use of your account or other security breach. We are not liable for any loss or damage arising from your failure to safeguard your account.

3. Subscription and Payment

Monthly Subscription: Biz Card Maverick operates on a subscription model with monthly billing. By subscribing, you authorize us (or our third-party payment processor) to charge you the monthly subscription fee on a recurring basis (each billing cycle) until you cancel. All fees are stated in U.S. dollars, and taxes may be added as required by law.

Free Trials: If we offer a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. You will be notified of any applicable trial terms when you sign up.

Cancellation by You: You may cancel your subscription at any time by contacting us through our designated “Contact Us” page [include Contact Us URL] or by sending a cancellation request to our support email. Cancellation requests should be submitted at least a few days before your next billing date to avoid being charged for the next month. If you cancel, your subscription will remain active until the end of the current paid billing period, and you will not be charged again thereafter. We do not provide pro-rated refunds for partial months of service unless required by applicable law.

Changes in Fees: Subscription fees may change over time. We will provide you notice (for example, by email or in-app notification) at least 30 days in advance of any increase in the price of your monthly subscription. If you do not agree to the new price, you may cancel your subscription before the change takes effect. Continued use of the Service after the price change takes effect constitutes your acceptance of the new fees.

4. User Data and Privacy

Business Card Information: When you use Biz Card Maverick to scan a business card, the Service will extract contact details (such as name, job title, company, email address, phone number, etc.) from the card (“Business Card Data”). You retain whatever ownership or rights you have in the Business Card Data you upload. These Terms do not grant us ownership of your contacts; however, by using the Service, you grant us a license to process and use the Business Card Data for the purpose of providing and improving the Service (for example, storing the data for you, organizing it, syncing it with integrations, and enabling follow-up communications as described below). This license is worldwide, non-exclusive, royalty-free, and covers any format or medium necessary to operate the Service. We will handle all personal information, including Business Card Data, in accordance with our Privacy Policy (which is incorporated into these Terms by reference).

Your Responsibility for Contact Data: You represent and warrant that you have the right to collect and use the contact information you scan with Biz Card Maverick. This means that when you scan a business card, you have obtained it through a legitimate professional interaction and (either explicitly or implicitly) the cardholder’s consent to use their contact details for follow-up. You agree not to scan or upload any business cards or contact information that you do not have permission to use. You are solely responsible for the content of the Business Card Data and ensuring that your collection and use of that data (including any communications you send to those contacts) complies with all applicable privacy, data protection, and anti-spam laws.

Data Accuracy: You acknowledge that business card scanning relies on technology (such as optical character recognition and AI) and may not be 100% accurate. Biz Card Maverick does not guarantee that the information extracted from business cards will be correct, complete, or free of errors. It is your responsibility to review and verify the accuracy of scanned data before using it (for example, before saving to your contacts or sending communications).

5. Acceptable Use and User Responsibilities

We expect users to use Biz Card Maverick in a lawful, ethical, and responsible manner. By using the Service, you agree that you will NOT:

  • Violate Laws or Rights: Use the Service in any way that violates any applicable law or regulation, or in a manner that infringes or misappropriates the privacy, intellectual property, or other rights of any third party. This includes compliance with anti-spam and data protection laws when contacting individuals whose information you obtained via Biz Card Maverick.
  • Abuse or Misuse the Service: Attempt to probe, scan, or test the vulnerability of the Service or breach any security or authentication measures. You will not misuse the Service by introducing viruses, malware, or any other harmful material, or by interfering with or disrupting the integrity or performance of the Service.
  • Unauthorized Access: Share your account with others who are not authorized, or use another person’s account without permission. You will not attempt to gain unauthorized access to any portion of the Service or its related systems or networks.
  • Non-Business Use: Use Biz Card Maverick for personal consumer purposes, or upload content that is unrelated to professional business contacts. The Service is not to be used to store or manage personal contacts outside of a business context.
  • Resell or Exploit: Resell, rent, lease, or provide access to the Service to a third party (except as permitted through authorized team or enterprise accounts), or exploit the Service for any commercial purpose not expressly permitted by these Terms. You also agree not to scrape, bulk download, or otherwise harvest data from the Service for outside use, except via any official export features provided for your account data.
  • Offensive or Illegal Content: Use the Service to transmit or store any content that is unlawful, defamatory, harassing, obscene, or otherwise objectionable, including in any automated emails or messages sent through Biz Card Maverick.

Compliance: You are responsible for ensuring that your use of Biz Card Maverick (including all Business Card Data you upload and any communications you send) is in compliance with these Terms and any applicable laws or regulations. Failure to adhere to the above commitments constitutes a breach of these Terms and can result in suspension or termination of your account (see Termination below).

6. Automated Email Communications

Follow-Up Emails: Biz Card Maverick provides an automated email feature designed to help you conveniently follow up with new contacts. When you scan a business card, the Service may automatically draft and/or send a follow-up email to the contact on your behalf. The purpose of this email is to politely acknowledge your recent interaction (for example, to say “It was nice to meet you” or to share your contact details). This automated communication is considered a core feature of the Service intended to mirror a common professional courtesy.

User’s Responsibility: By using Biz Card Maverick, you acknowledge and consent to these automated emails being sent from your email address or through our system identifying you as the sender. You are responsible for the content of these follow-up emails as if you wrote them yourself. We may provide email templates or use AI to help generate the content, but you are ultimately responsible for reviewing (where possible) and ensuring the communications are appropriate and do not violate any law. Each automated email will identify you (the Biz Card Maverick user) as the sender and will include an option for the recipient to opt out of further communications.

No Liability for Communications: Biz Card Maverick (Client Focused Media) is not liable for any consequences arising from the automated emails or other communications sent through the Service. This includes, but is not limited to, any claim that such an email was unsolicited, unwanted, or spam, or any outcome (positive or negative) of subsequent communications or relationships. You agree that it is your responsibility to obtain any necessary consent from your contacts to receive communications and to honor any request from a recipient to stop further contact. If you do not wish an automated email to be sent to a particular contact, do not scan that individual’s business card into the app.

7. Third-Party Services and Integrations

Integrations: Biz Card Maverick may integrate with or allow you to connect to third-party services, such as Customer Relationship Management (CRM) systems or email marketing platforms (for example, the GoHighLevel CRM provided via Client Focused Media’s systems, or workflow automation services like Make.com, etc.). These integrations are offered to enhance your experience by syncing data or automating tasks. By enabling or using any third-party integration, you authorize us to send your data (such as contact information) to the third-party service as needed to operate that integration. You acknowledge that when data is transferred to a third-party platform, it will be processed under that third party’s terms and privacy policy.

No Control Over Third Parties: Any third-party services or links accessed through Biz Card Maverick are outside of our control. We do not own, operate, or manage these external platforms. We provide integrations or links for your convenience and do not endorse or assume any responsibility for third-party services. If you access or use a third-party service (whether through an integration link or API connection), you do so at your own risk. The terms and conditions and privacy policies of the third-party service will govern your use of that service. It is your responsibility to review and comply with those terms.

Third-Party Disclaimers: We make no warranties or guarantees about the availability, accuracy, or performance of any third-party integration. For example, if Biz Card Maverick syncs contact data to an external CRM or triggers an email campaign via a third-party service, we are not liable for any failure in those processes, any errors or data loss that occur on the third-party side, or any harm resulting from actions of the third-party service. Any dispute or issue between you and a third-party provider is solely between you and that provider. However, we welcome feedback and will try to assist in resolving integration issues to the extent we can.

8. Intellectual Property Rights

Our Intellectual Property: The Biz Card Maverick Service (including our website, mobile app, software, algorithms, design, and all content provided by us) is owned by Client Focused Media and its licensors and is protected by copyright, trademark, and other intellectual property laws. Biz Card Maverick, the Biz Card Maverick logo, and any other product or service names or slogans that appear in the app or website are trademarks of Client Focused Media or its affiliates. We reserve all rights in and to our Service and intellectual property not expressly granted to you in these Terms.

Limited License to You: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Biz Card Maverick app and Service solely for your internal business purposes. This license is for use of the object code of our software (for example, the mobile app) and is not a sale or transfer of any intellectual property rights to you. You may not copy, modify, distribute, sell, or lease any part of our software or Service, nor may you reverse engineer or attempt to extract the source code of our software, unless laws prohibit those restrictions or you have our written permission.

User Feedback: If you choose to provide us with ideas, suggestions, or feedback about Biz Card Maverick or our services (“Feedback”), you agree that we are free to use and implement that Feedback (or not use it) in any way, without any compensation or obligation to you. You hereby grant us a perpetual, irrevocable, worldwide license to use any Feedback you provide for any purpose.

9. Termination and Suspension

By You (Closing Your Account): You may stop using Biz Card Maverick at any time. You may also delete your account by contacting us with a request to delete or by using any self-service account deletion function we provide. Termination of your account will typically take effect at the end of your current subscription period if you have an active subscription (see Subscription and Cancellation above for ending your paid subscription). After account deletion, we may retain backup copies of your data for a limited period as allowed by our Privacy Policy, but it will no longer be accessible to you.

By Us (Account Suspension/Termination): Client Focused Media reserves the right to suspend or terminate your account (or your access to certain features of the Service) at our sole discretion, especially in cases of misuse or abuse. We may do so with or without notice to you if we reasonably believe that: (a) you have violated any provision of these Terms or law; (b) your use of the Service is causing harm or liability to other users, third parties, or us; or (c) we are required to do so to comply with a legal requirement or court order. We may also suspend or terminate the Service or any portion of it, or remove any content from our Service, if we determine it is necessary for security or maintenance.

Effect of Termination: Upon termination of your account or this Agreement for any reason, your right to access or use the Service will immediately cease. We may disable your account and prevent further access to the Service, and you must cease all use of Biz Card Maverick. Any accrued rights and obligations will survive termination. No Liability for Termination: Biz Card Maverick shall not be liable to you or any third party for any termination of your access to the Service or for the deletion of your data in accordance with these Terms. (This does not limit any rights you may have under law to obtain a copy of your data or our obligations under the Privacy Policy.)

10. Disclaimers of Warranties

“As Is” Basis: Biz Card Maverick is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Service and your use of it. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We make no guarantee that the Service will meet your requirements or expectations.

No Guarantee of Error-Free Operation: We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. While we strive for high availability and accuracy, we do not guarantee that the Service (including any data outputs like scanned contact information) will always be accurate, reliable, complete, or current. You acknowledge that use of the Service (including any action you take or refrain from taking based on information from the Service) is at your own discretion and risk.

Data and Content: Biz Card Maverick does not warrant or make any representation regarding the accuracy or reliability of any information obtained through the Service, including the Business Card Data scanned or any suggestions generated by AI features. No advice or information, whether oral or written, obtained from us or through the Service, will create any warranty not expressly made herein.

Third-Party Services: We expressly disclaim any responsibility or liability for any third-party services or content that you access through our Service (including through any integrations or links). These third-party services are provided “as is” as well. We do not warrant, endorse, or assume liability for any product or service advertised or offered by a third party through Biz Card Maverick.

Not Professional Advice: The Service includes tools to manage contacts and communications, but Biz Card Maverick is not an email service provider or business consultant and does not provide professional advice. Any information or automation provided is for your convenience and should not be construed as legal, financial, or other professional advice. Always exercise your own judgment when using contact data and sending communications.

No Support Obligation: While we aim to provide helpful customer support and fix issues, we are under no obligation to provide specific technical support or to continue providing updates or maintenance for the Service indefinitely. We may, at our discretion, discontinue or change any part of the Service (though we will endeavor to notify users of major changes or discontinuations).

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, any implied warranties are limited to the minimum scope and duration permitted by law.

11. Limitation of Liability

Indirect Damages: To the fullest extent permitted by law, in no event will Biz Card Maverick, Client Focused Media, or any of our officers, employees, agents, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Service or these Terms. This limitation applies to any damages for lost profits, lost data, loss of goodwill, business interruption, or other intangible losses, even if we have been advised of the possibility of such damages.

Direct Damages Cap: To the fullest extent permitted by law, our total liability to you for any claims arising from or related to the Service or these Terms is limited to the amount you paid us for the Service in the 12 months immediately preceding the event giving rise to the liability, or USD $100, whichever is greater. If you have not paid any amount (for example, if you are using a free trial or free tier), our liability to you shall not exceed USD $100. This limitation is cumulative and will not be increased by the existence of more than one claim or event.

Release of Liability: You agree that we have no liability for any claims arising out of your provision of Business Card Data or automated communications to third parties. You release Biz Card Maverick (and our affiliated companies and agents) from any claim, complaint, or cause of action, known or unknown, in any way connected with disputes you may have with any third parties (for example, the recipients of your emails or the provider of a third-party integration). You also agree that our suppliers and integration partners will have no liability to you arising from your use of the Service or any third-party services.

These limitations of liability form an essential basis of the bargain between you and us, and will survive and apply even if any limited remedy in these Terms is found to have failed of its essential purpose.

Certain jurisdictions do not allow the exclusion or limitation of certain damages. If those laws apply to you, some or all of the above limitations may not apply to you, and you may have additional rights. In such cases, our liability is limited to the greatest extent permitted by law.

12. Governing Law

Governing Law: These Terms and any dispute arising out of or related to the Service or your use of it shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Jurisdiction and Venue: You agree that any claims or disputes arising between you and Biz Card Maverick that are not subject to arbitration (if any) will be resolved exclusively by a court of competent jurisdiction located in Florida. You consent to the personal jurisdiction of such courts. (If you reside outside the United States, you agree that you may initiate proceedings in Florida and also consent to the jurisdiction of Florida courts.)

13. Changes to These Terms

We may revise or update these Terms of Use from time to time. If we make material changes, we will notify you by email or by prominently posting a notice within the app or on our website prior to the change becoming effective. The notice will designate a reasonable advance notice period, after which the new Terms will take effect. Continued use of Biz Card Maverick after updated Terms take effect will indicate your acceptance of the changes. If you do not agree to the revised Terms, you should stop using the Service and, if applicable, cancel your subscription before the changes take effect.

14. Miscellaneous

Entire Agreement: These Terms (along with the Privacy Policy and any additional guidelines or terms provided for specific features) constitute the entire agreement between you and Client Focused Media regarding Biz Card Maverick. They supersede all prior understandings or agreements (whether oral or written) regarding the Service. Any additional or different terms proposed by you (for example, in a purchase order) are rejected unless expressly agreed to in writing by an authorized representative of Biz Card Maverick.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

No Waiver: Our delay or failure to exercise or enforce any term or condition of these Terms shall not constitute a waiver of such term or any other term. A waiver on one occasion shall not constitute a waiver on any other occasion.

No Third-Party Beneficiaries: These Terms are for the benefit of you and us only. No third party (other than our affiliates and successors in interest) shall have any rights to enforce any term of this Agreement.

Assignment: You may not assign or transfer these Terms (or any of your rights or obligations hereunder) without our prior written consent. We may assign or transfer this Agreement to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.
